When you type "accept" or enter an "Access Code" to use our service you are acknowledging and accepting our Terms of Use, and our Acceptable Use Policy. Our Terms of Use are provided here for your information.

We will treat your personal information in accordance with our Privacy Policy

We will provide you with the service in accordance with these terms.
(Us, we and our refers to the hotel, its management and our service providers).

Your responsibilities

You are responsible for all your activities while using the service.

You are responsible for use of the service through this connection even if it is used by someone else with or without your permission.You must monitor use of the service by a minor.

You must pay for all charges in using the service.

Your acknowledgments

You acknowledge that:

• No service level - We make no service level promises for this service. The service may encounter faults and errors including interruptions, timeouts and low speeds. We can not promise that faults or errors will be fixed in any timeframe.
• No security - We make no promises about the security of the service. You transfer data at your own risk. You are responsible for encrypting the data you transfer and protecting your computer from unauthorised access. Wireless connections may be significantly less secure than wireless connections.
• No content filter - We are not responsible for content that you access.

Liability and indemnity

Given the nature of telecommunication systems and the fact we get broadband capacity from a 3rd party, we provide the service on an 'as is' basis.

Our aggregate liability to you (including your officers, employees, agents and contractors) for any proven losses or damages of any kind caused by or resulting from any wrongful, wilful or negligent act or omission of us (including our officers, employees, agents or contractors) including liability for breach, in negligence or in tort or for any other common law or statutory action, is limited to the sum of the amounts paid or payable by you for use of the service in the 24 hours before the relevant act or omission.

In no event will our liability to you (including our officers, employees, agents and contractors) include any indirect, incidental, special or consequential damages, including loss of revenue, profits, anticipated profits, savings or data whether foreseeable or not and whether or not such loss or damage arises from an act or omission which is negligent and even if notified of the possibility of that potential loss or damage.

Any representation, warranty, condition or undertaking that would be implied in these terms by legislation, common law, equity, trade, custom or use is excluded to the maximum extent permitted by law. However nothing in these terms excludes, restricts or modifies any condition, warranty, right or remedy conferred by law that cannot be excluded, restricted or modified. To the fullest extent permitted by law, our liability for a breach of a non excludable condition or warranty is limited, at our option, to supplying of the services again or the payment of the cost of having the services supplied again.

You indemnify us against any loss, damage, liability, expense, cost or charge arising directly or indirectly from or incurred in connection with:

1. your breach of this agreement or the Acceptable Use Policy; and

2. your negligent act or omission.

Suspension

We may suspend the service if you breach these terms or our Acceptable Use Policy.

Monitoring

We may monitor your use of the service.

We never sell or trade personal information collected from your use of the service.

We may collect and store the following information about your use of the service:

• the IP and MAC address of your device;
• the time you use the service and the amount of data you transfer; and
• the sites and locations you visit or transfer data with.

We may use the information we collect about you for charging, investigating misuse of the service, service administration and as allowed by law.

Changes to terms

These may change from time to time without notice to you.
